Prairie Federal Credit Union
Agreement and Federal Disclosure for Online Banking

Prairie Federal Credit Unionís (Prairie Federal) Online Banking is subject to the Electronic Funds Transfer Act, appropriate state and federal laws, and Prairie Federalís Deposit Account Terms and Conditions. The use of Online Banking may also be subject to other terms, conditions, and requirements as Prairie Federal may establish them from time to time. All services added later are covered under this agreement and your signature and use of those new services authorizes Prairie Federal to carry out transactions under Online Banking.

Required Equipment
Prairie Federal is not responsible for any errors or failures from any malfunction of your computer, the browser or the software. Prairie Federal is also not responsible for any computer virus or related problems that may be associated with the use of an online system.

The Service
To use Online Banking, you must have at least one Prairie Federal personal. Through Online Banking, you will have access to any of your Prairie Federal share accounts or loan accounts. Prairie Federal reserves the right to deny access to a deposit account or loan account or to deny transactions under certain circumstances.

Description of Online Banking
The Service allows you to perform some or all of the following functions from your Computer:

Online Account Access Functions and Limitations of Transfers
You may use Online Banking to (a) transfer funds between your accounts; (b) obtain account balances; (c) obtain history and transaction information on your accounts; and (d) obtain loan account balance information. These features are limited to the extent, and subject to the terms, noted below.

  • Your ability to transfer funds between certain accounts is limited by federal law and the Deposit Agreement. You should refer to the Deposit Agreement for legal restrictions and service charges applicable for excessive withdrawals or transfers. Transfers made using Online Banking are counted against the permissible number of transfers described in the Deposit Agreement.
  • There may be at least a one-business-day delay in transferring funds between your accounts. Except as provided in this Agreement, all Online Banking transaction instructions received by 6.00 p.m. CST will be completed that business day. Any instructions received after 6:00 p.m. CST will be completed the next business day.

Online Banking on Your Mobile Phone
Prairie Federal will not be responsible for charges you may receive from your cellular phone provider should you choose to access online services from your mobile phone. This includes text messages as well as internet service charges.

Personal Identification Number and Security
Your Online Banking password is required to access Prairie Federalís Online Banking functions. You agree not to give or make available your password to any unauthorized individual. The safeguarding of your password is solely your responsibility. If you allow anyone access to your password, whether they are an authorized signer on your account or not, you will not hold Prairie Federal liable for the transactions that take place as a result of someone else using your PI password N. If you believe your password has been lost or stolen, someone has attempted to use the Online Banking service without your consent, your deposit account(s) or loan account(s) have been accessed, or someone has transferred money without your permission, you must notify Prairie Federal immediately. Prairie Federal does not maintain a record of your password. If you lose or forget your password, contact Prairie Federal immediately so that you may select a new confidential password.

Errors and Questions
Telephone Prairie Federal as soon as possible if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement. If you believe your account information and/or password has been lost or stolen, you agree to notify Prairie Federal within 2 business days of the loss or theft. If you discover there is an error or unauthorized transaction on your account, Prairie Federal must hear from you no later than 60 days after the mailing of the FIRST statement on which the problem or error appeared. Your inquiry must include:

  • Your name and account number,
  • A description of the error or the transfer you are unsure about and an explanation of why you believe it is an error or why you need more information,
  • The dollar amount of the suspected error, and
  • The date of the occurrence.

If you tell Prairie Federal verbally, you may be required to send your complaint or question in writing within 10 business days. You will generally receive the results of the investigation within 10 business days of the receipt of your complaint or question (20 business days if the transaction involved an account opened within the past 30 days). If more time is needed, however, it could take up to 45 days. If it is decided that there was no error, you will be sent a written explanation.

Alterations and Amendments
The terms of this Agreement, applicable fees, and service charges may be altered or amended by Prairie Federal from time to time. In such event, Prairie Federal shall send notice to you either at your address as it appears on Prairie Federalís records or by online notice through Online Banking. Any continuation of Online Banking after Prairie Federal sends you a notice of change will constitute your agreement to such change(s). Further, Prairie Federal may, from time to time, revise or update the Online Banking program, services, and/or related material(s) rendering such prior versions obsolete. Consequently, Prairie Federal reserves the right to terminate this Agreement as to all such prior versions of the Online Banking programs, services, and/or related material(s) and limit access to more recent versions and updates of Online Banking.

Prairie Federal Liability
Prairie Federal will NOT be liable for:

  • If, through no fault of the Credit Union, you do not have enough money in your account to carry out the transaction or a hold has been placed on your account.
  • If the Online Banking system is not in communication with its central computer.
  • If circumstances beyond the Credit Unionís control (such as a fire or flood) prevent the transaction.

Unless there is negligence on the part of Prairie Federal, you agree to waive all present and future claims against the Credit Union and release Prairie Federal of all loss or damages which might occur through unauthorized transactions from your account(s) through the custody or use of the password.

If you default in any amount you owe under this agreement, you agree to pay any and all attorney fees and collection costs incurred by Prairie Federal.

Prairie Federal reserves the right to discontinue Online Banking service to you without notice and will not be liable for failure to honor any Online Banking transactions.

Termination or Discontinuation
Termination of Online Banking by you is done by not accessing or using the Service. However, any transactions or payments you have previously authorized will be completed as instructed. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement.

Governing Law
This Agreement shall be governed by the laws of the jurisdiction of North Dakota and by applicable Federal laws and regulations.

Federal Disclosure
You agree to accept the disclosure online rather than a paper disclosure. It is recommended that you print the entire Agreement and Disclosure for your records. If you are unable to print this, please request a paper disclosure to be mailed to you.
