Aurora Federal Credit UnionONLINE BANKINGTERMS AND DISCLOSURES This Agreement establishes the rules that cover your electronic access to your account(s) at Aurora Federal Credit Union (“Credit Union”) through the online banking system. Your use of Online Banking is deemed acceptance of the terms and conditions of this Agreement. This Agreement, together with the Membership and Account Agreement constitutes the entire agreement between you and the Credit Union with respect to the subject matter hereof. Our Customer Service Information Our Customer Service is available at (303) 755-2572 or (877) 755-2572 or via e-mail at info@auroracu.com during the following hours (all Federal Reserve Banking holidays are observed): 8:00 A.M. to 5:00 P.M. (MST), Monday thru Wednesday 9:00 A M to 5:00 P M (MST). Thursday 8:00 A.M. to 5:00 P.M. (MST), Friday ENROLLMENT Your member account number and the last four digits of the Social Security Number are required for initial enrollment to Online Banking. If you have changed your PIN via Telephone Teller or previously updated with a member service representative at the Credit Union – please use that updated PIN for enrollment. ACCOUNT ACCESS You may access your account using the Online Banking Service at any time, seven (7) days a week, twenty-four (24) hours a day using standard PC Internet access. Access our home page at www.mbrcu.com to get to the login screen. To qualify for access, you must be a Credit Union member in good standing. Some or all of the services may not be available occasionally due to scheduled system maintenance or emergency situations such as hardware failure. FEES Currently, there are no monthly or transaction fees for accessing your account using this service. We retain the right to implement fees in the future under applicable federal and/or state regulations and in such case; we will notify you as soon as practicable and within required legal requirements. If at that time, you choose to discontinue using Online Banking, you must notify us in writing. SERVICES Transfers - You may transfer funds within your account and other accounts. This includes savings, clubs, share draft (checking) and loans. Transfers done on the system will immediately affect your account. External Account Transfers - You may transfer funds from your Credit Union account to accounts at other financial institutions. Transfers done on the system will immediately affect your account. Withdrawals - You may request a withdrawal from your savings or checking account. These will affect your account immediately. If the withdrawal is done while the credit union is closed, the withdrawal will be mailed on the next business day. Our business days are Monday through Saturday, excluding holidays. Balances - You may view your share and loan account balances and availability and payoffs, where applicable. These balances are real-time balances, but will not include drafts, ATM/debit card or other electronic transactions which you may have done, but are not yet posted by the credit union. Transaction History - We will permit access to all transactions on your account that have occurred in the past 90 days. These transactions will not include drafts, ATM/debit card or other electronic transactions which you may have done, but are not yet posted by the credit union. We also allow you to access draft history, in sequential order. Password Changes - You may change your Online Banking password at anytime. For your protection, keep this password secret and change it on a regular basis. The staff at the credit union does not have access to your password, and must reset your account if it is forgotten. Additional Services - We may offer new services at any time. These presented terms and conditions also apply to the additional services, unless specifically noted otherwise. LIMITATIONS Federal regulations limit preauthorized transfers from your regular share (savings) account to no more than six (6) per account per month. This includes transfer by phone, fax, overdraft and Internet transfer. The credit union reserves the right to limit the number and amount of transactions in the future. PERIODIC STATEMENTS You will continue to receive a monthly statement of account unless there is no draft or electronic activity, in which case you will receive a quarterly statement. We may offer electronic delivery of your statement, and if applicable, will notify you via e-mail when the statement is available. YOUR LIABILITY By using Online Banking access, you agree to accept responsibility for protecting the integrity of your PIN, in order to prevent unauthorized transactions and/or account access. You also agree that the credit union may revoke your Online Banking account access if unauthorized account access and/or transactions occur as the apparent result of your negligence in safeguarding the PIN. Granting access to your account via Online Banking to any other person (non-owner) will make you financially liable for all unauthorized access, losses or misuse of the account, until reported to the Credit Union. You will be liable for unauthorized access to accounts via Online Banking to the extent allowed by applicable federal and state law. You must tell us AT ONCE if you believe your Member number, or PIN, or any record thereof, has been lost or stolen, or if any of your accounts have been accessed without your authority. You may telephone us at (877) 755-2572, E-mail us at info@auroracu.com, or mail to Aurora Federal Credit Union 6 Abilene St., Aurora, CO 80011. Telephoning is the best way of minimizing your liability. You could lose all the money in your accounts, plus your maximum overdraft line-of-credit. If you tell us within two (2) business days of the loss, theft, or unauthorized access, you can lose no more than $50 if someone accessed your account without your permission. If you do NOT tell us within two (2) business days after you learn of the loss, theft or unauthorized access, and we can prove we could have stopped someone from accessing your account without permission if you had notified us, you could lose as much as $500. Further, if your statement shows transfers that you did not make, you must tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not receive any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money had you notified us in time. OUR LIABILITY If the Credit Union does not complete a transfer, loan advance, or withdrawal to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages resulting from this failure to act. However, there are some exceptions. We will not be liable: 1) If through no fault of ours, you do not have available funds to make the transfer and/or withdrawal; 2) If the system was not working properly and you knew of the breakdown when you started the transaction; 3) If the system fails to perform your transaction due to a mechanical or software malfunction beyond our control; 4) If your account is flagged for a lost/stolen password, or unauthorized transaction on the account; 5) If circumstances beyond our control, such as, fire or flood, prevent the transaction despite reasonable precautions we have taken; 6) If the Credit Union has terminated this Agreement with the member; 7) If a legal order directs us to prohibit withdrawals from the account(s) or funds are subject to legal encumbrance; 8) If other exceptions are introduced as provided by applicable law. ERRORS AND QUESTIONS In case of errors or questions about your Online Banking transactions, telephone us at (303) 755-2572 or (877) 755-2572; write us at 6 Abilene St. Aurora, CO 80011; or e-mail us at info@auroracu.com as soon as you can. We must hear from you no later than sixty (60) days after you learn of the error. You will need to inform us via written statement with the following information:
If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will notify you with the results of our investigation within 10 business days (20 business days if your complaint or question involves a transaction to or from an account within 30 days after the first deposit to the account was made) after we hear from you. We will correct any error promptly. If we need more time, we may take up to 45 days (90 days if your complaint or question involves a transaction to or from an account within 30 days after the first deposit to the account was made) to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days (20 days if the complaint or error involves a transaction to or from an account within 30 days after the first deposit to the account was made) for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within 10 business days, we may not credit your account. If we decide that there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may request copies of the documents we used in our investigation. If you need more information about our error resolution procedures, call us at the telephone number shown above. MISCELLANEOUS All credits are provisional and accepted subject to the provisions of the Uniform Commercial Code and the Aurora Federal Credit Union by-laws. Except as governed by federal law, this agreement is governed in accordance with the laws of Colorado. We reserve the right to limit access or cancel on-line access at any time. |
